Penalties for OVI in Ohio

Blood Alcohol Concentration (BAC) BELOW .17
Mandatory Jail time 3 days to 6 months (usually 3 days in Driver’s Intervention Program (“D.I.P.”))
Fines $375 - $1,075
Driver’s License Suspension 1-3 years
BAC of .17 or higher Minimum - 6 days in jail or 3 days in jail and 3 days in D.I.P.

Second OVI within 10 years - first-degree misdemeanor

Mandatory Jail time 10 days to 6 months (typically straight, no chance for D.I.P.; (possible for some time on house arrest; possible alcohol monitoring ankle bracelet)
Fines $525- $1,625
Driver’s License Suspension 1-7 years
Alcohol Addiction Treatment Minimum 3 months
Immobilization of Car 90 days
BAC of .17 or higher Minimum - 20 days in jail

Third OVI within 10 years - Unclassified misdemeanor

Mandatory Jail time 30 days to 1 year (possible for some time on house arrest; possible alcohol monitoring ankle bracelet)
Fines $850 - $2,750
Driver’s License Suspension 2-12 years
Alcohol Addiction Treatment Formal Program
Criminal Forfeiture of car Permanent
BAC of .17 or higher Minimum - 60 days in jail

Fourth or Fifth OVI within 10 years or Sixth within 20 years fourth-degree felony

Mandatory Jail time 60 days to 30 months
Fines $525- $1,625
Driver’s License Suspension 1-7 years
Alcohol Addiction Treatment Formal Program
